These general terms and conditions of sale govern all relationships between Falinia Gestión S.L. and its online customers (“the Customer”).

Before making any transaction, the Customer acknowledges having read and expressly accepts these terms and conditions by clicking on the “I Accept” button.

Falinia Gestión S.L. is a commercial entity, and as such, in relation to sales made through its portal or other means, it complies with the applicable commercial laws and consumer rights regulations in force at any given time.

1. Identification

Falinia Gestión S.L., with registered address at Calle La Deseada 51B, San Miguel de Abona, CIF B65984759, registered in the Commercial Registry of Tenerife, Volume 3285, Folio 160, Page TF-52173, is the owner of the website: www.barrancodelinfierno.es.

Falinia Gestión S.L. is the concessionaire responsible for the maintenance, control, and access management of the Special Nature Reserve “Barranco del Infierno” in Adeje.

2. Website Content and Information

Falinia Gestión S.L. reserves the right to modify at any time the characteristics of the commercial offers presented on the website.

Falinia Gestión S.L. provides commercial information truthfully. However, this information may occasionally contain typographical errors. In such cases, and completely beyond our control, these errors will be corrected immediately.

3. Special Sales Conditions

The Customer acknowledges having read and accepted the special sales conditions displayed on the screen (date, trail access conditions, required documentation, visit duration, group size, guided access conditions, service costs, etc.).

The purchase of access tickets or the booking of guided tours implies the full and unconditional acceptance of the special sales conditions, which apply exclusively to the contracted products or services.

4. Purchasing Process

The Customer begins the purchase process by selecting the desired date in the reservation calendar. The order is added to a total that includes all confirmed products. Before completing the order, the Customer must click on the button “I accept the general terms and conditions of sale and proceed with the payment” in the menu bar.

5. Applicable Taxes

The prices of the products and services displayed on the Falinia Gestión S.L. website include the General Indirect Canary Tax (IGIC) where applicable.

6. Payment Methods

For online purchases made through www.barrancodelinfierno.es, only electronic card payments or PayPal are accepted.

Cash payments by mail or other postal systems will not be accepted under any circumstances.

7. Purchase Confirmation

Once the payment is completed, the Customer must print the access ticket, which specifies the exact entry time and reservation number.

Entry to the Barranco del Infierno is strictly prohibited without a valid ticket, regardless of whether a reservation or payment was made. The ticket must be kept until the exit.

For discounted tickets, valid proof of residency must be presented. If the visitor fails to provide valid documentation, they will have to purchase a new ticket at full price.

8. Customer Rights: Returns and Withdrawal

The Customer has a 14-day withdrawal period, provided that the cancellation is communicated at least 3 days before the reserved date. The Customer must notify Falinia Gestión S.L. within the established deadline using any legally accepted means.

If the withdrawal is communicated in due time, Falinia Gestión S.L. will refund the purchase amount to the credit card used, within the legally established period.

If the withdrawal is not communicated at least 3 days in advance, no refund will be issued, and no changes will be made to the reservation.

In case of closure due to rain or wind, the Customer will have two options:

  1. Reschedule the reservation.
  2. Receive a full refund.

If the Customer reschedules the reservation, the 3-day notice policy will apply again for any future modifications.

If the cancellation is made with at least 3 days’ notice, the ticket will remain valid for one year.

Due to limited capacity, it is recommended to arrive at least 15 minutes before the scheduled entry time. If the Customer arrives late, entry is not guaranteed.

9. Warranty and Liability

Barranco del Infierno is a Special Nature Reserve. Falinia Gestión S.L. does not guarantee refunds for access difficulties due to natural causes (rain, storms, etc.).

Falinia Gestión S.L. will be responsible for the consequences of failure to execute or improperly execute the contract in proportion to its role in managing the access and maintenance of the Barranco del Infierno trail.

However, Falinia Gestión S.L. will not be liable in cases of force majeure (unexpected, extraordinary circumstances beyond control), when the Customer or a third party is responsible, or when the incident could not have been foreseen or prevented.

Claims must be submitted on-site or as soon as possible in writing. If a dispute arises, the Customer may escalate the case to the competent authorities for mediation.

If the conflict is not resolved, the Customer may pursue arbitration or judicial proceedings. Falinia Gestión S.L. is not a member of the consumer arbitration system.

10. Changes to the General Terms and Conditions

Falinia Gestión S.L. reserves the right to modify these General Terms and Conditions (GTC) at any time.

Changes will be made in accordance with applicable laws. Modifications will not affect Customers with previously purchased tickets.

11. Personal Data Protection

By using the services of Falinia Gestión S.L. on www.barrancodelinfierno.es, users voluntarily provide personal data (“Personal Data”).

Falinia Gestión S.L. processes this data securely and confidentially in accordance with the General Data Protection Regulation (GDPR) and Spanish data protection laws.

Users have the right to access, rectify, delete, and oppose the processing of their data.

12. Proper Use of Website Content

14. Governing Law and Jurisdiction

These General Terms and Conditions are governed by Spanish law. Any disputes will be resolved in the courts of Santa Cruz de Tenerife.

15. Validity

These General Terms and Conditions were drafted on April 27, 2015, and remain in effect indefinitely unless modified.
